RENTAL TERMS & CONDITIONS


TERM OF AGREEMENT - The term of this agreement is ______ months.  There is a two-month non-refundable minimum rent, due on possession.  However, Lessee may return the instrument (with accompanying articles) at any time without any further obligation; however, terminating this agreement will not release Lessee from the obligation of paying all past due payments.  Lessor agrees not to change or increase the monthly rent for the term of the agreement.

MAINTENANCE PROGRAM - Coverage is added per month due on the monthly payment and would apply to the current month only.  Coverage must be initiated at the time this agreement is consummated and is valid only until the agreement is terminated.  Maintenance must be performed at Dorsey Music.  Coverage details listed at bottom of agreement.


LOSS OR DAMAGE - The instrument will be returned in the same condition in which it was received, except for normal wear due to the use for which the instrument was intended.  The Lessee shall bear the entire risk of loss or damage beyond normal wear to the instrument.

LATE CHARGES - Past due accounts over 15 days will automatically be charged a $10.00 late fee.  Amounts past due over 30 days may be charged to my credit card.

DEFAULT - If account becomes delinquent over 60 days, Lessor shall have the right to take immediate possession of any and all instruments wherever same may be located, without demand or notice, without any court order or other process of law, and without liability to Lessor for any damages occasioned by taking possession.  Lessee hereby waives any claim of liability against any third party on account of such taking of possession, including schools, school districts, landlords, or any commercial enterprise.  Lessee agrees to indemnify Lessor and hold Lessor harmless against any claim of liability against Lessor by reason of Lessor's taking possession pursuant to this paragraph.  Any such taking of possession shall constitute a termination of this agreement and shall not release the Lessee from the obligation of past due payments. 

PURCHASE OF INSTRUMENT - Lessor and Lessee hereby stipulate that should both parties fulfill all obligations under this agreement at the end of the TERM OF AGREEMENT as indicated above, the value of the instrument shall be the amount listed as the "Residual Value" above.  Both parties acknowledge the possibility  that the residual value may not reflect the actual value of the instrument at that time, which may be more or less depending on the circumstances.  At the end of the term of agreement, Lessee may opt to purchase the instrument for the residual value.  Lessee may pay the residual value in three equal monthly installments.  Lessee may also elect, during the first 6 months of the agreement to purchase the instrument, by payment in full of the sales price of the instrument, and will get full credit for all timely payments under this agreement.

TRADE IN VALUE - During the term of the TERM OF AGREEMENT, Lessee may at his option trade up to a similar instrument of greater value.  Lessee will be given credit for 50% of the payments made under the original agreement.  Trade in will not effect the term of the agreement.  A new residual value is necessarily agreed upon. 

CREDIT CHECK - Dorsey Music may, at their sole discretion, choose to perform a credit check for the purpose of assessing risk and evaluating a prospective renter's financial capability to successfully make all payments required during the rental term.



MAINTENANCE COVERAGE DETAILS -
 

Flutes, Saxophones, Clarinets, Oboes:

  •     Replacement of necessary pads, corks, springs
  •     Regulation of mechanism and leak-check
  •     Silver solder any broken keys
  •     Free any frozen rods

Trumpets, Cornets, Trombones, Baritone Horns:

  •     Replacement of water key and valve corks
  •     Pulling frozen mouthpieces
  •     Cleaning and freeing all frozen slides
  •     Solder broken or loose braces
  •     Replacement of necessary springs, felts
  •     Clean, buff, oil, and regulate pistons and slides
  •     Remove bell dents only
  •     For trombones, align and clean playing slide

French Horns:

  •     Re-string and regulate rotary valves
  •     Pulling frozen mouthpieces
  •     Cleaning and freeing all frozen slides
  •     Solder all broken or loose braces
  •     Replace necessary springs and felts
  •     Remove bell dents only

Snare Kits:

  •     Replace any broken heads
  •     Replace any broken rods, lugs, or dampener mechanism
  •     Tuning and adjustment
  •     Repair or replace any broken stands

Violins, Violas, Cellos:

  •     Replace any broken strings, bridges, pegs, and bow if broken or warped (not bow hair)

COVERAGE DOES NOT INCLUDE:

  •     Intentional damage or abuse to the instrument or case
  •     Restoration of finish, lacquer finishes or silver-plated surfaces
  •     Replacement of accessory items such as reeds, lubricants, mouthpieces, straps, drumsticks, drum pads, etc.
  •     Loss of instrument or accessories
  •     Restoration of the body and finish of stringed instruments
  •     General cleaning of the instrument
